Cobb Woman Charged with DUI in East Cobb Traffic Fatality

The car driven by Cynthia Max hit and killed an 85-year-old Marietta woman Tuesday afternoon on Terrell Mill Road.

Cobb Police have charged a Powder Springs woman with driving under the influence following a Tuesday afternoon two-car wreck that killed a Marietta woman in East Cobb.

According to Sgt. Dana Pierce, Cynthia Max, 45, was taken to the Cobb County Adult Detention Center after the car she was driving struck the driver’s side door of Kathryn J. LaPointe's vehicle at approximately 3:10 p.m.

LaPointe, 85, was transported to Wellstar Kennestone Hospital by ambulance but died as a result of the injuries she received in the collision.

Preliminary information from investigators along with witness information from the scene indicates that LaPointe was driving of a white 2006 Ford Taurus and was turning left from a private drive of the Cobb Parkway Walmart onto northbound Terrell Mill Road. 

At the same time, Max was driving a silver Hyundai Tucson and was traveling southbound on Terrell Mill approaching the intersection of the private drive. As LaPointe’s car pulled out, it was struck on the driver’s side by Max’s Hyundai.

Max refused treatment for the minor injuries she received in the crash.
